The EPO is renowned for its quality, but one area where practitioners sometimes struggle is Art. 123(2) EPC. Anecdotally, the EPO has the toughest added matter standard of anywhere in the world, despite consultation with users over the past few years. Legal certainty for third parties is essential, so is fair protection for the patentee.
